The boy was abducted from outside his home in Lumberton, about 95 miles south of Raleigh, on the morning of November 5. The police said the abductor had seduced him into a careless SUV of a relative and drove away. The body of the eight graders is located three weeks later.
After eight days after kidnapping, Michael Ray McLellan became a police officer an unnamed attempt by the kidnapping case from October.
The FBI matches DNA from the car at Hania's disappearance with a previous DNA sample linked to McLellan, according to authorities. He was accused of death's Hania in December, the hours before his funeral.
McLellan rejected bail in many cases relating to Hania's death, including first-degree murder and first-degree rape.
He was scheduled to appear in court on April 2. CNN tries to find out if McLellan is being appointed by a lawyer.
